SECTION 1
Introduction
This website (the “Website”) is owned and operated by AirPay Financial Technologies Pty Ltd (ABN 99 615 157 572) (“AirPay”, “we”, “us”, “our”).
By purchasing any goods, digital products, or services through this Website (including any AirPay Gift Card or other digital payment product), you agree to be bound by these Terms and Conditions of Sale (“Terms”).
These Terms are in addition to any specific Product Terms applicable to each AirPay Gift Card or digital product, which are available on the Website or within the AirPay app.
- Unless otherwise stated, this Website and the related services are only available to users located within Australia.
We may add to, change, suspend or discontinue any part of the Website at any time without notice or liability, where required by law or for legitimate operational reasons. AirPay will honour all Gift Cards already purchased prior to any such change, in accordance with the applicable Product Terms and the Australian Consumer Law.
SECTION 2
AirPay Gift Cards and Digital Payment Products
Each AirPay Gift Card or Digital Card (“Gift Card”) is an electronic stored-value payment mechanism issued by our licensed issuing partners (“Issuers”) and redeemable at participating merchants. AirPay acts as a distributor and payment facilitator, not as the issuer, unless expressly stated in the relevant Product Terms.
Each Gift Card is governed by its Product Terms, which specify validity period, permitted usage, and merchant acceptance conditions. You should review those Product Terms before purchasing.
Gift Cards contain unique identifiers and may include a PIN or activation code (“Card Information”). AirPay securely transmits this data in accordance with its Privacy Policy.
- Restrictions on Gift Cards: Gift Cards are issued for personal use only. The commercial resale, bulk purchase for resale, or on-selling of Gift Cards is prohibited. AirPay reserves the right to cancel Gift Cards purchased in a manner that constitutes commercial resale, bulk acquisition for resale, or any other misuse contrary to the intended personal use of Gift Cards.
SECTION 3
Ordering and Payment
To place an order
- Select the desired Gift Card type, value, and quantity
- Either check out as a guest or create an AirPay account
- Provide recipient details (which may be yourself or another person)
Payment must be made using an accepted payment method. Orders will be processed only after successful payment verification.
- Your contract with AirPay is formed when we issue an electronic tax invoice confirming your order and providing an order reference number.
We may accept or reject an order, or cancel and deactivate Gift Cards, if payment is not verified, fraud or misuse is suspected, the product is unavailable, or we reasonably believe the order would breach the Product Terms or Applicable Law.
SECTION 4
Delivery, Refunds and Cancellations
Upon payment confirmation, we will activate and send the Gift Card(s) or digital product(s) to the nominated email or AirPay Wallet.
Delivery depends on your email or internet service provider. We are not responsible for failures, deletions, or misdeliveries caused by third-party systems or incorrect recipient information.
- For disputes involving electronic payment facilities covered by the ePayments Code (administered by ASIC), the Code's specific liability provisions may apply to eftpos and certain domestic card transactions. AirPay will notify merchants of any Code-specific requirements.
Except as required under the Australian Consumer Law or relevant Product Terms, orders are generally not cancellable or refundable once issued.
- Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
SECTION 5
Compliance, Licensing and AML/CTF
AirPay and its partners hold applicable authorisations and registrations for regulated financial and payment services:
AirPay conducts customer due diligence (CDD) and transaction monitoring in accordance with its obligations under the AML/CTF Act, including:
- screening all customers and beneficial owners against the DFAT Consolidated Sanctions List and UN Security Council sanctions lists; and
- filing reports with AUSTRAC as required by law, including IFTI and suspicious matter reports (SMRs).
- The existence or contents of any SMR cannot be disclosed under s123 of the AML/CTF Act.
AirPay reserves the right to cancel, suspend, or refuse any order or Gift Card where required by law, AUSTRAC directive, or sanctions compliance.
SECTION 6
Privacy and Data Protection
We collect and process personal information solely to fulfil your orders and manage our services, in accordance with our Privacy Policy available at www.airpayfintech.com/privacy-policy/. This includes compliance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the AML/CTF Act 2006 (Cth) as amended by the AML/CTF Amendment Act 2024 (Cth).
We employ encryption and secure transmission protocols to protect payment card and personal data. We retain transaction records for a minimum of seven (7) years in accordance with s105 of the AML/CTF Act.
SECTION 7
Intellectual Property
All content on this Website, including text, graphics, logos, and software, is the property of AirPay or its licensors and is protected by Australian copyright law. You must not reproduce, distribute, or modify any Website content without prior written consent.
SECTION 8
Limitation of Liability
To the extent permitted by law and consistent with the Australian Consumer Law, AirPay’s liability in connection with these Terms is limited to the face value of the Gift Card or product purchased.
AirPay is not liable for any indirect, special, incidental, or consequential loss arising from your use of the Website or any Gift Card, except where liability cannot be excluded under Australian law.
SECTION 9
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales. Nothing prevents either party from seeking equitable relief in any jurisdiction.
- Nothing in this clause limits the right of an Australian consumer to commence proceedings in a court of competent jurisdiction in the State or Territory in which they are located, or to exercise any right available to them under the Australian Consumer Law or any other applicable consumer protection legislation.
